1. Agreement to Terms

By accessing or using hvaczar.com ("the Site"), you agree to be bound by these Terms of Service ("Terms"). HVACZAR is an authorized independent dealer of MrCool products. We are not owned by, operated by, or affiliated with MrCool LLC beyond our authorized dealer relationship. If you disagree with any part of these Terms, you may not access the Site or purchase products.

2. Products and Pricing

All products listed on the Site are subject to availability. Prices are displayed in US dollars and are subject to change without notice. While we strive for accuracy, we reserve the right to correct pricing errors at any time — including after an order has been placed. In such cases, we will notify you and offer the option to proceed at the corrected price or cancel for a full refund.

We reserve the right to limit order quantities, refuse any order, or cancel orders at our discretion, including orders that appear to be placed by dealers, resellers, or distributors.

3. Orders and Payment

By placing an order, you represent that: (a) you are at least 18 years old, (b) you are authorized to use the payment method provided, and (c) the billing and shipping information you provide is accurate. All payments are processed securely through Stripe. HVACZAR does not store credit card numbers.

An order confirmation does not guarantee acceptance. We reserve the right to verify orders before processing, particularly for high-value transactions. Orders are subject to product availability and payment authorization.

4. Shipping and Delivery

Shipping times are estimates and are not guaranteed. We ship via FedEx, UPS, and truck freight carriers depending on product size. Shipping is calculated at checkout from the weight of your order — ground service for parts and accessories, truck freight with liftgate delivery for equipment.

Risk of loss and title pass to you upon delivery to the carrier. Once the tracking number shows the package as delivered to the carrier, HVACZAR is not responsible for loss, damage, or theft during transit. We strongly recommend purchasing shipping insurance for high-value orders. For freight deliveries, inspect all packages for visible damage before signing — note any damage on the delivery receipt.

5. Returns and Restocking

We accept returns within 30 days of delivery for unused, unopened products in original manufacturer packaging. See our full Returns Policy for details.

  • A 15% restocking fee applies to all equipment returns (mini splits, condensers, air handlers, heat pumps, packaged units, furnaces)
  • Customer is responsible for return shipping costs
  • Original shipping costs are non-refundable
  • Products must be unused, uninstalled, and in original sealed packaging
  • A Return Authorization (RA) number is required before shipping any return
  • Returns without an RA number will be refused
  • Refunds are processed within 5-7 business days of receiving the return

Installed, opened, used, or modified products cannot be returned under any circumstances. Once refrigerant lines are connected or electrical connections are made, the product is considered installed and is no longer eligible for return. This applies to both DIY and professionally installed products.

6. Warranty

All products are covered by the manufacturer's warranty as specified by MrCool LLC. HVACZAR does not provide any warranty beyond the manufacturer's warranty. Warranty coverage, duration, and terms are determined solely by MrCool LLC. Warranty claims must be filed directly with MrCool. As an authorized dealer, purchases from HVACZAR are eligible for full manufacturer warranty coverage when properly registered.

HVACZAR is not responsible for warranty claim outcomes, processing times, or manufacturer decisions regarding warranty coverage.

7. Installation Disclaimer

IMPORTANT: HVAC equipment installation involves electrical work, refrigerant handling, and structural modifications. Even "DIY" branded products require basic electrical knowledge, including but not limited to: installing a dedicated circuit breaker, wiring a disconnect box, and making proper electrical connections.

HVACZAR is not responsible for:

  • Improper installation by the customer or any third party
  • Damage to the product caused by incorrect installation
  • Damage to property caused during or after installation
  • Personal injury resulting from installation
  • Voided warranties due to improper installation
  • Code violations or permit issues
  • Electrical damage, fires, or flooding from improper installation

You are solely responsible for ensuring that installation complies with all local building codes, electrical codes, and permit requirements in your jurisdiction. We strongly recommend hiring a licensed electrician for the electrical portion of any HVAC installation, even for DIY systems.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HVACZAR, ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO: YOUR USE OF THE SITE OR PRODUCTS, INSTALLATION OF PRODUCTS, PRODUCT PERFORMANCE OR FAILURE, SHIPPING DELAYS OR DAMAGE, THIRD-PARTY SERVICES, OR ANY OTHER MATTER RELATED TO YOUR PURCHASE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM A PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

9. Dispute Resolution

Any dispute arising from these Terms or your purchase shall first be addressed through good-faith negotiation by contacting us at [email protected]. If the dispute cannot be resolved within 30 days, either party may pursue resolution through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in the state where HVACZAR is registered. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

10. Intellectual Property

All content on this website — including text, graphics, logos, and software — is the property of HVACZAR or its licensors and is protected by copyright and trademark laws. MrCool, the MrCool logo, and all MrCool product names are trademarks of MrCool LLC, used under authorized dealer license.

11. Indemnification

You agree to indemnify and hold harmless HVACZAR, its owners, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from: your use of the Site, your violation of these Terms, your installation or use of products, or your violation of any law or third-party rights.

12. Governing Law

These Terms are governed by the laws of the United States. Any legal action must be brought in the courts of the state where HVACZAR is registered.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14. Changes to Terms

We may modify these Terms at any time by posting the updated version on this page with a new "Last updated" date. Continued use of the Site after changes constitutes acceptance of the modified Terms.
